Germany: Multi-year Prison Sentences for Hamas Members
A German court has convicted four individuals of membership in the terrorist organization Hamas. The defendants, all born in Lebanon and aged between 36 and 58, were found to be 'foreign operatives' responsible for managing Hamas weapon depots located in various European countries, including Poland, Bulgaria, and Denmark. The court in the capital imposed prison sentences ranging from four and a half to six years.
Presiding Judge Doris Husch in Berlin stated that the accusations made by the Federal Public Prosecutor's Office were confirmed "to the full conviction of the Senate." The top German prosecution authority had originally requested sentences between five and seven years.
Establishing a Logistics Network
According to the indictment from the Federal Public Prosecutor's Office, the four men were actively involved in establishing a logistical network aimed at preparing potential attacks on Jewish or Israeli facilities within Germany and other European nations. They were apprehended in December 2023. Three of the convicted individuals primarily resided in Germany, while one lived predominantly in the Netherlands.
The men consistently denied their membership in Hamas, the Islamist Palestinian organization that governs the Gaza Strip. The defense attorneys for three of the defendants sought acquittals. The principal defendant admitted during the trial to having visited a weapons depot in Bulgaria, but claimed his involvement was merely "private arms trading."
The verdict is not yet legally binding. Based on earlier statements from the defense, it is anticipated that they will appeal the decision, leading the case to be heard before the Federal Court of Justice in Karlsruhe.
Intelligence Service Provides Leads
The Federal Public Prosecutor's Office reported receiving a tip from the Federal Office for the Protection of the Constitution shortly after Hamas's terrorist attack on Israel on October 7, 2023. This information pertained to a "conspiratorial weapons-related operation by Hamas in Germany," which prompted the initiation of covert investigations.
Hamas is committed to the destruction of the State of Israel and is designated as a terrorist organization by Germany, the EU, the USA, and several Arab states.
In recent months, the Federal Public Prosecutor's Office has ordered the arrest of eight additional suspects in connection with alleged weapons procurement for Hamas. Most recently, in January, a suspect was detained at Berlin Airport upon entering the country from Beirut, the capital of Lebanon.
